1. Services

Minko provides an API-driven platform that retrieves and analyzes publicly available professional profiles, company information, and posts, along with enrichment and analytics. Our Services are primarily intended for sales and recruitment professionals.

We may modify, suspend, or discontinue any part of the Services at our discretion.

2. Eligibility

You must:

Be at least 18 years old;
Have the authority to enter into these Terms on behalf of yourself or your organization;
Comply with all applicable laws and regulations.

3. Accounts & Access

You are responsible for safeguarding your account credentials and API keys.
You must not share accounts without authorization.
We may suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

Use the Services for unlawful purposes (e.g., spamming, harassment, fraud, or discrimination).
Resell, redistribute, or misuse the data beyond your subscription rights.
Interfere with our systems or bypass usage/rate limits.

5. Data & Privacy

Minko provides access to publicly available or user-permitted data.
Data accuracy, completeness, and timeliness are not guaranteed.
You are responsible for compliance with data protection and privacy regulations applicable to your use of the Services.

6. Payment & Billing

Fees are billed according to your subscription plan.
Payments are non-refundable.
Unpaid accounts may be suspended or terminated.
Pricing may change at any time at our discretion.

7. Intellectual Property

All intellectual property rights in the Services (APIs, software, databases, documentation) belong to Poso Services LLC.
Customers retain rights to data outputs they lawfully generate.
No ownership rights are transferred under these Terms.

8. Third-Party Services

The Services may integrate with third-party platforms (such as CRMs). Use of those services is subject to their own terms, and we are not responsible for their operation.

9. Disclaimers

The Services are provided “AS IS” without warranties of any kind.
We do not guarantee uninterrupted, error-free, or secure operation.
Data provided may be incomplete, outdated, or inaccurate.

10. Limitation of Liability

To the fullest extent permitted by law:

Poso Services LLC shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services.
We hold no responsibility whatsoever for any claims, losses, or liabilities of any kind, whether in contract, tort, or otherwise.

11. Indemnification

You agree to indemnify and hold harmless Poso Services LLC, its affiliates, and employees from claims, damages, or expenses arising from:

Your use of the Services,
Your breach of these Terms,
Your violation of third-party rights.

12. Termination

We may suspend or terminate your access if you:

Breach these Terms,
Fail to pay subscription fees,
Misuse the Services.

Upon termination, your right to access the Services ends immediately.

13. Governing Law and Jurisdiction

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

14. Changes to Terms

We may update these Terms from time to time. Continued use after changes indicates acceptance of the updated Terms. We may or may not notify users of any such changes.
